1. Overview & Definitions
These Platform Terms of Service ("Platform Terms") govern your subscription to and use of the DohOps software platform — the scheduling, time tracking, task management, and workforce analytics application accessible at dohops.com/auth/login and associated mobile applications.
These Platform Terms are separate from the DohOps website Terms of Service, which govern use of the marketing website at www.dohops.com. Both apply to you.
Key definitions:
- "Platform" means the DohOps software-as-a-service application and all associated APIs, mobile apps, and integrations
- "Operator" or "you" means the business entity subscribing to the Platform
- "Administrator" means the individual(s) within your organization who manage your DohOps account
- "Employees" means the individuals whose data you manage within the Platform as part of your workforce operations
- "Operator Data" means all data you input into or generate within the Platform, including employee schedules, time records, task completions, photos, and business data
- "We," "us," "our" means DohAssist LLC
By activating a free trial or paid subscription, you agree to these Platform Terms on behalf of yourself and the business entity you represent.
2. Subscription & Free Trial
Free Trial. New operators may access the full DohOps Platform for 30 days at no charge, with no credit card required. The free trial includes up to 6 users and unlimited locations with full access to all Standard plan features.
The free trial begins on the date you activate your account and ends 30 days later. At the end of the trial period, your account will enter a read-only state — you can still view your data, but new scheduling, clock-in events, and task submissions will not be accepted until you activate a paid subscription.
Free-trial-to-paid conversion. We will notify you by email at 7 days before and 1 day before your trial expires. To continue without interruption, activate a paid plan before your trial ends. Your trial data — including all employee records, schedules, time events, and task records — carries over to your paid account automatically.
Standard Plan. $79/month. Includes 6 users and unlimited locations. Additional users are billed at $8/user/month. The Standard plan includes all core platform features: GPS time clock, Smart Scheduling, AI Job Assignments, Bonuses & Gamification, Hiring & Onboarding tools, and Operations Suite.
Enterprise Plan. Custom pricing for operators with 50+ locations or enterprise requirements. Contact sales@dohassist.com or call +1 (602) 750-0711.
Concierge Add-Ons. DohOps Concierge plans (Light, Standard, Full) are available as add-ons to the Platform subscription. Concierge pricing is custom-quoted and not published. Contact us for a quote.
3. Billing & Payment
Billing cycle. Paid subscriptions are billed monthly in advance on the anniversary of your activation date. If you activate on the 15th of the month, you are billed on the 15th of each subsequent month.
Payment method. We accept major credit and debit cards. Payment is processed by our third-party payment processor. We do not store your full card number — only the last four digits and expiration date are retained for billing reference.
Price changes. We will notify you at least 30 days before any price change affecting your subscription. Price changes take effect on the next billing cycle after the notice period. If you do not agree with a price change, you may cancel before the new price takes effect — see Section 4.
Late payments. If a payment fails, we will retry the charge and notify you by email. Subscriptions that remain unpaid for more than 15 days after the due date may be suspended. We will provide at least 5 days' notice before suspending a subscription for non-payment. Service is restored upon receipt of all outstanding amounts.
Taxes. Prices listed are exclusive of applicable taxes. You are responsible for any sales tax, VAT, or similar taxes applicable to your subscription based on your location and applicable law.
4. Cancellation Policy
How to cancel. You may cancel your subscription at any time by contacting us at support@dohassist.com or through the account settings in the Platform. Cancellations take effect at the end of the current billing period — you will not be charged for the following month.
No refunds for partial months. We do not provide refunds for the unused portion of a billing period. If you cancel on day 10 of a 30-day billing cycle, you retain access through the end of that cycle and are not charged for the next cycle. No partial refund is issued for the remaining 20 days.
Data retention after cancellation. After your subscription ends, your account enters a 60-day data retention window. During this window, you can reactivate your subscription and all data will be intact. After 60 days without reactivation, your Operator Data is scheduled for deletion. To request data export before deletion, see Section 7.
Termination by DohAssist. We may terminate or suspend your subscription immediately for: material breach of these Platform Terms, non-payment after the notice period, use of the Platform in connection with illegal activity, or behavior that is abusive or threatening toward our team. We will provide written notice of termination and the reason.
Effect of termination. Upon termination, your right to access and use the Platform ends. Your data remains available for export for 60 days post-termination unless termination is due to illegal activity, in which case data handling will comply with applicable law and our legal obligations.
5. Data Ownership
You own your Operator Data. All data you create, upload, or generate within the DohOps Platform — employee records, schedules, time and attendance records, task completions, photos, business data — belongs to you. DohAssist LLC does not claim any ownership of your Operator Data.
License to operate the platform. You grant DohAssist LLC a limited, non-exclusive license to process, store, and use your Operator Data solely for the purpose of providing the Platform services to you. We do not use your Operator Data to train AI models for third parties, sell it to advertisers, or share it with anyone except as described in these Platform Terms and the Privacy Policy.
Aggregated and anonymized data. DohAssist LLC may use aggregated, anonymized, de-identified data derived from Platform usage — across all operators — to improve the Platform, develop new features, and understand usage patterns. This data cannot be traced back to any individual operator or employee.
Your responsibility for employee data. As the operator, you are the data controller for your employees' personal data processed within the Platform (GPS records, photos, time records). You are responsible for: obtaining appropriate consent or other legal basis for collecting this data under applicable employment law, informing your employees about the Platform's data collection (GPS, photo capture) before they use it, and responding to employee data requests in accordance with applicable law. We will assist you in responding to employee data requests as required by our Privacy Policy.
6. Uptime & Availability
Our commitment. DohAssist LLC will use commercially reasonable efforts to maintain DohOps Platform availability. Our target is 99.5% uptime measured monthly, excluding scheduled maintenance windows.
We do not make a legally binding uptime guarantee or SLA for Standard plan subscribers. Enterprise plan subscribers may negotiate SLA terms with uptime commitments and credit remedies. Contact sales@dohassist.com for Enterprise SLA terms.
Scheduled maintenance. We perform routine maintenance during low-traffic periods (typically 2–5 AM Central Time on weekdays). We will provide at least 24 hours' advance notice for maintenance windows longer than 2 hours that are expected to affect availability.
Unplanned outages. In the event of an unplanned outage, we will communicate status updates at status.dohops.com (or by email for significant outages) and will work to restore service as quickly as possible.
Force majeure. DohAssist LLC is not liable for downtime caused by events outside our reasonable control, including internet infrastructure failures, third-party cloud provider outages, natural disasters, government actions, or other force majeure events.
Kiosk and offline mode. DohOps's kiosk clock-in mode supports offline queuing — clock events recorded while offline are queued and submitted when connectivity is restored. This reduces the impact of internet outages on your store operations.
7. Data Export on Cancellation
Your right to export. You may request a full export of your Operator Data at any time during your subscription and within 60 days of account closure. We will provide your data in a standard, machine-readable format (CSV for tabular data, JPEG/PNG for photos, ZIP archive for bulk exports).
How to request export. Email support@dohassist.com with "Data Export Request" in the subject line, or contact your account manager if you are on a Concierge plan. Include your account name and the data categories you want to export.
Export timeline. We will provide your data export within 30 days of receiving a valid export request. For large accounts (50+ locations with years of data), we will notify you of the expected timeline.
Export contents include:
- Employee records (names, contact info, roles, PINs — PINs in hashed form)
- All time and attendance records with GPS coordinates
- All schedule records
- All task assignments and completion records
- All photos submitted via task completion (if requested — large file size)
- All payroll export records generated during your subscription
No export fee. Data export is provided at no additional charge as part of your subscription or within 60 days of cancellation.
After 60 days. Operator Data is scheduled for deletion after the 60-day post-cancellation window. If you need your data after this window, contact us — we will make reasonable efforts to recover it if the deletion cycle has not yet completed, but we cannot guarantee recovery after this point.
8. Acceptable Platform Use
You may use the DohOps Platform only for your legitimate workforce management operations. The following are prohibited:
- Using the Platform to track or monitor individuals without their knowledge in contexts that violate applicable employment or privacy law
- Sharing your account credentials with users outside your organization for purposes not related to your legitimate business operations
- Attempting to reverse-engineer, decompile, or extract source code from the Platform
- Using the Platform to send unsolicited commercial communications to employees or third parties
- Loading malicious code, viruses, or harmful content into the Platform
- Accessing other operators' accounts or data without authorization
- Using the Platform in connection with any fraudulent, illegal, or harmful activity
- Reselling, sublicensing, or making the Platform commercially available to third parties without our written permission
We reserve the right to investigate suspected violations and to suspend or terminate accounts that violate these terms.
9. Confidentiality
Your data stays private. DohAssist LLC will not disclose your Operator Data to third parties except as described in the Privacy Policy (service providers, legal requirements, business transfers) or as you explicitly authorize.
Our confidentiality to you. If we provide you with any proprietary technical information, pricing, or other non-public information about DohAssist LLC in the course of our commercial relationship, you agree to keep that information confidential and not share it with competitors or use it for purposes beyond evaluating or using the DohOps Platform.
Your data and the internet. DohOps transmits data over the internet using TLS encryption. No transmission method is 100% secure. We take reasonable precautions, but we cannot guarantee that intercepted transmission events will never occur.
10. Warranties & Disclaimers
What we warrant. DohAssist LLC warrants that the DohOps Platform will perform materially in accordance with its published documentation during your subscription period. If the Platform is not performing as documented, notify us at support@dohassist.com and we will work to resolve the issue in a commercially reasonable timeframe. If we cannot resolve a material non-performance within 30 days, you may cancel your subscription and receive a prorated refund of the current month's fees — this is our sole liability for warranty breach.
What we do not warrant. We do not warrant that:
- The Platform will be error-free or uninterrupted (see Uptime section)
- The Platform will meet any specific operational outcome or business result
- AI-scored task assessments will be 100% accurate — they are decision-support tools, not replacements for human review
- GPS geofencing will catch 100% of time fraud attempts — it is a strong deterrent and detection tool, not a guarantee
- Payroll export data will be accepted without modification by every payroll platform — formatting compatibility may vary
The Platform is provided "as is" with the limited warranty stated above. All other warranties — express, implied, merchantability, fitness for a particular purpose — are disclaimed to the maximum extent permitted by applicable law.
11. Limitation of Liability
To the maximum extent permitted by applicable law, DohAssist LLC's total aggregate liability for any and all claims arising from your use of the DohOps Platform will not exceed the total subscription fees paid by you in the 3 calendar months immediately preceding the event giving rise to the claim.
DohAssist LLC is not liable for:
- Indirect, incidental, consequential, special, or punitive damages
- Loss of profits, revenue, or business opportunities
- Loss of data except as provided in Section 7
- Business interruption costs
- Labor compliance penalties or fines resulting from your use or misuse of the Platform
- Any outcome from your employees' or managers' use of or failure to use Platform features
DohOps is a workforce management tool. Compliance with employment law, wage-and-hour regulations, scheduling law, and any other applicable regulation remains the operator's responsibility. The Platform provides tools to support compliance — it does not guarantee it.
12. Data Processing Agreement (DPA)
For operators who require a formal Data Processing Agreement — typically GDPR-covered businesses in the EEA or UK, California-covered businesses handling employee data at scale, or Enterprise clients with contractual requirements — DohAssist LLC will execute a DPA upon request.
The DPA covers: the roles of data controller (operator) and data processor (DohAssist LLC), the categories of personal data processed, processing purposes and lawful bases, sub-processor list and change notification process, data subject rights assistance, security measures, audit rights, international transfer mechanisms (Standard Contractual Clauses for EEA/UK transfers), breach notification, and data deletion upon termination.
To request a DPA, email privacy@dohassist.com with "DPA Request" in the subject line. We will provide our standard DPA within 10 business days. Enterprise clients may negotiate DPA terms as part of their Enterprise agreement.
13. General Terms
Entire agreement. These Platform Terms, together with the DohOps website Terms of Service and Privacy Policy, constitute the entire agreement between you and DohAssist LLC regarding the DohOps Platform. They supersede any prior or contemporaneous agreements on this subject.
No assignment. You may not assign your subscription or your rights under these Platform Terms to any third party without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of our assets.
Severability. If any provision of these Platform Terms is found to be unenforceable, the remaining provisions continue in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
Waiver. Our failure to enforce any provision of these Terms in a particular instance does not waive our right to enforce it in the future.
Governing law. These Platform Terms are governed by the laws of the State of Texas, without regard to conflict of law provisions. Disputes arising from these Platform Terms that cannot be resolved informally will be settled by binding arbitration in Travis County, Texas, under the rules of the American Arbitration Association.
Class action waiver. Any dispute resolution will be conducted on an individual basis only — not as a class, consolidated, or representative action.
Modifications. We will notify you by email at least 30 days before any material changes to these Platform Terms take effect. Your continued use of the Platform after the effective date of changes constitutes acceptance. If you do not agree with the changes, you may cancel before they take effect.
